At their August 23rd meeting, the Texas Transportation Commission canceled a procurement in which the private sector company Cintra had agreed to finance, construct, operate and maintain the SH 121 improvements. The commission also authorized TxDOT to continue finalizing an agreement with the North Texas Tollway Authority for the SH 121 project.
The commissioners' primary concern was the shift of financial risk from the private sector back to Metroplex drivers. But even in light of that issue, the commissioners felt that in order to comply with SB 792 past by the 80th legislative session, they had no choice but to cancel the private sector procurement and go forward with NTTA.
